Welcome to SmartHire247 ("Platform", "we", "us"). By registering, accessing, or using our services, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Platform.

1.1 Eligibility

• You must be at least 18 years of age to create an account.
• You must provide accurate, complete, and current information during registration.
• One person may hold only one account per role (Candidate, Employer, Franchise, Admin).

1.2 Account Responsibility

• You are solely responsible for maintaining the confidentiality of your password.
• All activities under your account are your responsibility.
• You must immediately notify us of any unauthorized use at support@smarthire247.com.

1.3 Acceptable Use

• Do not post fake, misleading, or fraudulent job listings or profiles.
• Do not attempt to scrape, hack, or disrupt the Platform.
• Do not use the Platform for illegal activities, discrimination, or harassment.
• Do not share your account credentials with third parties.

1.4 Intellectual Property

All content, designs, logos, AI algorithms, and features on SmartHire247 are the intellectual property of SmartHire247 and its licensors. You may not reproduce, distribute, or create derivative works without prior written consent.

1.5 Termination

We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or remain inactive for more than 12 months. You may delete your account at any time from your dashboard settings.

1.6 Governing Law

These terms are governed by the laws of India. Any disputes shall be resolved in the courts of New Delhi, India.

2. Privacy Policy

SmartHire247 is committed to protecting your personal data in compliance with the Digital Personal Data Protection Act (DPDPA), 2023 and applicable Indian privacy laws.

2.4 Your Rights

• Access — Request a copy of all data we hold about you.
• Correction — Update inaccurate data from your dashboard.
• Deletion — Request complete data deletion (GDPR/DPDPA right to erasure).
• Portability — Export your data in machine-readable format.
• Withdraw Consent — Revoke consent for optional data processing at any time.

2.5 Data Retention

We retain your data for as long as your account is active. After account deletion, data is permanently erased within 30 days, except where legal retention is required.

3. Terms for Candidates

3.1 Profile & Resume

• All information in your profile must be truthful and accurate.
• Fake degrees, certifications, or work experience will result in immediate account suspension.
• Your uploaded resume becomes part of your SmartHire247 profile and may be shared with employers you apply to.

3.2 Job Applications

• Applying for a job shares your profile (name, skills, resume, score) with the employer.
• SmartHire247 does not guarantee job placement — we facilitate connections.
• Interview scheduling and outcomes are between you and the employer.

3.3 SmartHire Score & AI Features

• Your SmartHire Score is calculated using AI based on profile completeness, skills, verifications, interview performance, and education.
• AI Mock Interview scores are based on keyword analysis, structure, and response length — they are indicative, not definitive.
• AI Resume Builder suggestions are automated — always review before downloading.

3.4 Verification

• Identity verification (Aadhaar/DigiLocker) is optional but improves your trust score and visibility.
• Verified candidates get a badge visible to employers.
• Submitting someone else's documents is a criminal offense and will be reported.

3.5 Referral Program

• Earn rewards by referring friends who register and get placed.
• Self-referrals or fake referrals will result in reward forfeiture and account suspension.
• Referral rewards are subject to applicable taxes.

4. Terms for Employers

4.1 Job Posting

• All job postings must be for genuine, legal employment opportunities.
• Misleading salary information, fake companies, or discriminatory requirements are strictly prohibited.
• Jobs are subject to admin review and may be rejected or flagged by our AI fraud detection system.
• Each job posting must include: title, description, location, salary range, and required skills.

4.2 Candidate Data

• You may only access candidate data for candidates who applied to your jobs or consented to profile sharing.
• Candidate data must not be shared, sold, or used outside SmartHire247.
• Downloading or scraping candidate data in bulk is prohibited.

4.3 Verification Credits

• Verification credits are used to verify candidate backgrounds.
• Credits are non-refundable once used.
• Unused credits remain valid for 12 months from purchase date.

4.4 Trust Score & Ratings

• Candidates can rate employers after placement (1-5 stars).
• Employer trust score is calculated from candidate ratings and verification status.
• Attempting to manipulate ratings (fake reviews, pressure tactics) will result in account action.

4.5 Placement Commission

• SmartHire247 charges a placement commission of 8.5% of the candidate's first annual CTC for successful placements facilitated through the Platform.
• Commission is invoiced after the candidate completes 30 days of employment.
• Failure to pay commission within 15 days of invoice will result in account suspension.

5. Terms for Franchise Partners

5.1 Franchise Agreement

• Franchise registration is subject to admin approval and background verification.
• Franchise partners must operate training centers in compliance with SmartHire247 quality standards.
• Use of the SmartHire247 brand, logo, and materials requires an active franchise agreement.

5.2 Revenue Sharing

• Course Fees: 70% to franchise, 30% to SmartHire247.
• Placement Commission: Shared per the franchise tier agreement.
• Royalty Fee: 15% of gross revenue, payable monthly.
• Marketing Fund: 2% contribution for national-level campaigns.
• Payouts are processed on a monthly cycle with a minimum threshold of Rs. 1,000.

5.3 Student Data & Placement

• Franchise partners must maintain accurate student records on the Platform.
• Placement claims must be verifiable — fabricated placements will lead to franchise termination.
• Student data belongs to SmartHire247 and may be used for platform-wide matching.

5.4 Quality Standards

• Maintain a minimum placement rate of 60% for active batches.
• Provide required infrastructure (computers, internet, classroom space).
• Participate in quarterly quality audits conducted by SmartHire247.
• Failure to meet quality standards may result in franchise downgrade or termination.

6. Refund & Cancellation Policy

6.1 Subscription Plans

• Subscription fees are non-refundable once the billing cycle begins.
• You may cancel your subscription at any time — access continues until the end of the current billing period.
• Downgrading a plan takes effect at the next billing cycle.

6.2 Verification Credits

• Purchased verification credits are non-refundable.
• If a verification fails due to a platform error, the credit will be restored.

6.3 Course Fees (Franchise)

• Course fee refund is subject to the individual franchise center's policy.
• If a student withdraws within 7 days of enrollment and has attended less than 10% of sessions, a full refund minus processing fees (5%) will be issued.
• After 7 days, refunds are at the discretion of the franchise center.

6.4 How to Request a Refund

Email refunds@smarthire247.com with your account details, transaction ID, and reason. Refund requests are processed within 7-10 business days.

7. Disclaimer & Limitation of Liability

7.1 No Guarantee of Employment

SmartHire247 is a job matching and career development platform. We do not guarantee employment, placement, salary levels, or interview outcomes. Our AI scoring and matching are tools to aid decision-making, not guarantees of results.

7.2 AI-Generated Content

• AI Mock Interview scores, resume suggestions, and skill gap analyses are automated and indicative.
• Always review AI-generated content before using it professionally.
• SmartHire247 is not liable for decisions made based on AI recommendations.

7.3 Third-Party Services

The Platform may integrate with third-party services (Razorpay for payments, DigiLocker for verification). SmartHire247 is not responsible for outages, data breaches, or issues caused by third-party providers.

7.4 Limitation of Liability

To the maximum extent permitted by Indian law, SmartHire247's total liability for any claims arising from use of the Platform shall not exceed the amount paid by you to SmartHire247 in the preceding 12 months, or Rs. 10,000, whichever is lower.
